1. GENERAL PROVISIONS
This Privacy Policy applies to users of the Website at the URL: https://www.fairwaysdrakensberg.co.za and is effective . The Controller of the users’ data is: (hereinafter referred to as “We”).
2. PERSONAL DATA
Following the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as “GDPR”), we inform you that:
1. We process data for the following purposes:
- a. performance of the contract or taking action at the request of the data subject before concluding the contract (legal basis: Article 6(1)(b) of GDPR),
- b. handling inquiries (Article 6(1)(f) of GDPR),
- c. handling complaints and claims (Article 6(1)(b) of GDPR),
- d. keeping records and fulfilling legal obligations imposed on the Controller (Article 6(1)(c) of GDPR),
- e. sending a newsletter (Article 6(1)(a) of GDPR),
- f. monitoring and improving the quality of the services – requesting completion of a survey or answering some questions about the quality of the services provided (Article 6(1)(f) of GDPR),
- g. displaying personalized commercial information on social networks (Art. 6(1)(a) of GDPR)
2. Providing data is voluntary, yet essential to use the services. In the case of expressing consent, it is voluntary and expressed by clicking the checkbox that includes the conditions of the consent granted.

If a person has agreed to the processing of data (legal basis: Article 6(1)(a) of GDPR), the data is processed until the consent is withdrawn, but after this period, we have the right to archive information on who and when, and what consent was given (to establish, assert or defending legal claims). In other cases, the data is processed for the period justified by the execution of the purpose (e.g. performance of the contract, answering questions, tax regulations, etc.). The period of processing depends on the possibility of establishing, asserting, or defending claims or when data retention is required due to tax regulations.

5. Each data subject has the right to access, correct, delete or restrict the processing of personal data, the right to object, the right to transfer data, and the right to complain with a supervisory authority.
6. Transaction data, including personal data, are transferred directly by the user to the payment service provider.
7. The Website visitors may fill in a form and subscribe to the newsletter and provide an e-mail address and/or telephone number for the automated contact.
8. The Website visitors may express their consent for Us to run advertising campaigns on social networks targeted based on their email addresses.
3. DATA RECIPIENTS
We use the services of software and ICT system maintenance companies with whom We have entered into appropriate agreements. These agreements include data processing rules and confidentiality. The data is not shared and none of these companies has the right to process the data in any other way than specified in the contract. Your data, if the company has access to it, may be processed only for the proper provision of services.
4. COOKIES
- Cookies are transferred to web browsers and are then stored in the memory of devices and read by the server each time you connect to the Website.
- We would like to point out that storing cookies does not allow us to access your private device or read any data other than the data stored in the cookies.
- We use the so-called technical cookies, which enable the correct use of the message transmission and remembering your settings,
- and to generate simple statistics of the Service.

5. Noise:
Please keep noise levels to a minimum and respectful of other guests at the resort. All noise levels to stop from 22H00 – 06H00. If you or your guests have been instructed to quieten down or to stop being a nuisance to other guests, you may be asked to leave the resort and will not be entitled to a refund for your booking.
6. Sundries:
Please note that check-in time is strictly from 15H00. You are required to pay a R3000.00 Key / Breakage deposit on arrival. This is refundable should there be no damages to the unit. Guests will personally be liable for any breakages or damages to the building and contents of the unit whilst you and, or your guests are in occupation. Check-out time is strictly at 10H00. Any check-outs after 10H00 will be charged at R500.00 per hour or part thereof. All sundry bills must be settled directly with the resort prior to departure.
7. No Smoking:
Smoking cigarettes, electronic cigarettes, vaping or hubble bubble in Villas or any buildings on the resort premises is strictly not permitted by law. Should Management, at their discretion, find that you and or your party has violated this policy, you will be liable to pay a fine, face criminal charged and be liable for damages.
8. Indemnity:
Only a person over 18 years may sign the Guest Registration Card at check-in. The indemnifier must remain in occupation for the duration of the stay. If the indemnifier vacates the unit, the remaining occupants may be asked to vacate the resort.
9. Acceptance:
Once payment is received, it is agreed that the terms and conditions have been accepted.
10. Pet Policy
Pets are strictly NOT allowed.
11. Liability:
We accept no liability whatsoever for any injury, death, loss, damage, or expense suffered by you, your guests, or anyone else taking occupation with you, arising from any act of God, theft, strike, fire or the acts or omissions of any other person, including but not limited to the local or national government, limitations, restrictions and requirements for visas, permits, licenses and certificates on border controls and immigration (if applicable), military, police and security services intervention, international and local travel, movement of goods and persons, occupation of accommodation and the use and enjoyment of facilities, amenities and public and private venues, while under the jurisdiction of such local or national government.
